1. Agreement to Terms

TonboAI provides AI-powered productivity tools including writing assistance, translation, image analysis, and code generation. By accessing or using the services provided by TonboAI (hereinafter referred to as "we," "us," or "the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not access or use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

3. Service Availability

TonboAI is not intended for use in all countries. For legal compliance and risk management, we strictly prohibit the use of the Service within the following Restricted Jurisdictions:

  • Trade Sanctions: Countries subject to U.S. embargoes (e.g., Cuba, Iran, North Korea, Syria).
  • Enforcement: We reserve the right to implement technical measures to block access from Restricted Jurisdictions. Accounts identified as operating within these regions will be terminated immediately without refund.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes. Prohibited activities include:

  • Using AI-generated content to spread misinformation, disinformation, or harmful content.
  • Attempting to reverse-engineer, extract, or replicate the underlying AI models.
  • Submitting content that violates third-party intellectual property rights.
  • Automating requests in a manner that places unreasonable load on the Service.
  • Using the Service to generate content that is illegal, abusive, or violates applicable laws.

5. AI-Generated Content

The Service uses third-party AI models to generate responses. AI-generated content is provided for informational and productivity purposes only. It may contain inaccuracies or errors and should not be relied upon as professional advice (legal, medical, financial, or otherwise). You are solely responsible for how you use AI-generated content.

6. Coins & In-App Purchases

TonboAI uses a virtual credit system called "Coins" (7 Coins ≈ $1 USD). Coins are consumed when you use AI features such as chat, image analysis, coding assistance, and translation; the amount consumed varies by feature and by which AI model you select. Coins are purchased as consumable in-app purchases through Apple's App Store in-app purchase system. All billing is handled by Apple; we do not collect or store your payment information. Purchased Coins are non-transferable, have no cash value, and are linked to your account.

7. Refund Policy

All purchases are made through Apple's App Store and are subject to Apple's refund policy. To request a refund, please use Apple's standard refund process via the App Store or reportaproblem.apple.com. We do not process refunds directly. Coins are a consumable digital item; once consumed, they are not eligible for a refund.

8. Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time from within the app. Upon account deletion, your data will be removed within 30 days in accordance with our Privacy Policy.

9. Limitation of Liability & Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, the Service operator shall not be liable for any indirect, incidental, or consequential damages resulting from the use of the Service or reliance on AI-generated content.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by updating the date at the top of this page. Continued use of the Service after changes constitutes your acceptance of the revised Terms.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, USA. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Wyoming.
